President Biden signs Executive Order to implement the European Union-U.S. Data Privacy Framework

October 7, President Biden signed an Executive Order on Enhancing Safeguards for United States Signals Intelligence Activities directing the steps that the United States will take to implement the U.S. commitments under the European Union-U.S. Data Privacy Framework announced by President Biden and European Commission President von der Leyen in March of 2022. The immediate next steps are that the European Commission will issue a draft “data adequacy assessment” for the United States, which must be approved and adopted by the 27 EU member states. For reference, this agreement will also unlock the ability for the U.S. to negotiate similar frameworks with the UK, Switzerland, and other non-EU markets across Europe.
